Who is responsible
TradeSmart is the trading name of Simon Klein, operating in Israel. Simon Klein is responsible for the personal information described in this policy. In this policy, “TradeSmart”, “we” and “us” refer to that business.
Business / legal-notice address: 68 Kanfei Nesharim St., Jerusalem 9546457, Israel. Privacy contact: simon@tradesmart4x.com.
This policy covers the TradeSmart website, enquiries, marketing communications, purchases, member access, recorded training, live sessions, the Trading Performance Diagnostic, assessments and private services. Payment, meeting, webinar, hosting and other service providers may also process information under their own notices.
Information we collect and why
We may collect name, email address and other contact details to respond to enquiries, register you for a service, identify your account and communicate with you.
For purchases and subscriptions, we process order, billing, payment-status and transaction records needed to take payment, deliver access, manage renewals, cancellations and refunds, prevent fraud and maintain required business records. Payment providers process card or account details under their own systems; do not send full card details to TradeSmart by email or support message.
For member access and training, we may process account, entitlement, login, access and progress information needed to provide and support the service.
For the Trading Performance Diagnostic, we process the answers you submit and the resulting educational assessment of trading-process areas. For private assessments or coaching, you may choose to provide trading plans, logs, journals, screenshots, examples, correspondence and other evidence relevant to the agreed work.
For sessions and support, we may process booking information, correspondence, working notes, questions, session contributions and recordings where applicable.
Technical information can include IP address, browser and device information, requested pages, timestamps, security events and information generated by cookies or similar technologies. Marketing records can include your consent status, unsubscribe status and, where lawfully enabled, email-open, link-click or similar engagement information.
Providing information is generally voluntary, but we may be unable to answer a request, process an order, provide a Diagnostic result or deliver a service without information necessary for that purpose. Marketing consent is not required to purchase training. For the Trading Performance Diagnostic, the required acknowledgement may cover storage and use of your answers, contact about your result and relevant TradeSmart services connected with that result, as stated at the point of submission.
Please provide only information relevant to the service. Remove unnecessary account numbers, third-party names and unrelated personal details from trading records where possible. Do not send brokerage credentials, full payment-card details, identity documents or health information unless a specific need and suitable process have been explained.
Trading Performance Diagnostic and educational profiling
The Trading Performance Diagnostic evaluates responses across defined trading-process areas to generate an educational result and indicate where further attention may be useful. This may involve automated scoring or routing. It is not an automated investment-suitability decision and does not instruct you to buy or sell a financial instrument.
The result can be affected by incomplete answers, limited evidence or inaccurate self-assessment. You can contact TradeSmart at simon@tradesmart4x.com to correct information, ask for an explanation or request human consideration of a result. Any follow-up paid service is a separate choice.
Recordings and participation
Private sessions may be recorded for the agreed client work, relevant follow-up and internal review where appropriate notice and any required permission have been obtained. Access is limited to Simon Klein and authorised service providers or personnel who need the recording for those purposes.
Private-session recordings are not made available to other customers or used in public marketing without separate, specific permission. Permission for internal client work is not blanket permission to publish a testimonial, repurpose an identifiable private session as public course content or use it for an unrelated purpose.
Live Trading Room and Weekly Market Analysis & Preparation sessions may be recorded for member replays included in those services. Before or when participating, you should be informed about the relevant recording arrangement. Do not disclose confidential account information or another person's information in a group session.
Legal bases and purposes
We process information only where permitted by applicable law. Depending on the activity and the law that applies, processing may be necessary to take steps you request before a contract, perform a contract, comply with a legal obligation, pursue a proportionate legitimate interest, or act on your consent.
Where consent is required for marketing, optional tracking, recordings or another specific purpose, it is treated separately from acceptance of purchase terms. A general terms checkbox is not treated as permission for unrelated marketing.
Service providers and disclosures
TradeSmart uses service providers as needed to operate the website and deliver services. Current arrangements include Kartra for functions such as checkout, member access, account administration and communications; Google services for the Diagnostic and related processing; website hosting and delivery services; payment providers such as PayPal where offered; and meeting, webinar, scheduling or communications tools used for the relevant service.
Providers receive information needed for their role. Some process information on TradeSmart's instructions; others, particularly payment, security and communications providers, may have their own legal duties and purposes. Information may also be disclosed to professional advisers where necessary, in response to a valid legal obligation, or to establish, exercise or defend legal rights.
Submitting information to TradeSmart does not authorise unrelated marketing by another Simon Klein business merely because a service provider or backend account is shared.
International processing
Some providers may process information in countries other than your own. Where applicable law requires safeguards or another lawful mechanism for an international transfer, TradeSmart will use the applicable mechanism. Use of the website is not, by itself, consent to every overseas transfer.
Cookies, analytics and similar technologies
The website and connected services may use cookies or similar technologies needed to operate forms, maintain sessions, secure services, process purchases, provide member access and remember choices.
TradeSmart may also use analytics and platform measurement, including Google Analytics and Kartra-related tracking, where implemented. Optional analytics, advertising or marketing tracking will be used only with the information and choices required by applicable law. Where prior consent is required, optional technologies should remain inactive until consent is given.
Email systems may record delivery, opens or link interactions where that functionality is enabled and lawful. You may be given additional controls or notices depending on the service and your location. Blocking technologies necessary for a requested service can affect sign-in, checkout or other functionality.
Marketing communications
TradeSmart sends marketing only where permitted by law and in accordance with the choices recorded for you. Where a form uses a separate marketing opt-in, it is optional. The Trading Performance Diagnostic may instead use one required acknowledgement covering storage and use of Diagnostic answers, contact about the result and relevant TradeSmart services connected with that result. You can unsubscribe using the link in a marketing email or contact TradeSmart.
Unsubscribing from marketing does not cancel a purchase, booking or member access and does not prevent service, transactional, security or legally required messages. TradeSmart may keep a minimal suppression record so that an opt-out remains effective.
Retention
TradeSmart keeps personal information only for as long as reasonably necessary for the purpose for which it is used and for applicable legal, accounting, tax, security, complaint or claims requirements.
Enquiry records are kept for the period needed to answer and appropriately follow up the enquiry. Contract, transaction and access records are kept for the period needed to administer the purchase and meet applicable legal and accounting obligations. Diagnostic responses, trading evidence and private working material are kept for the period reasonably needed to deliver the requested result or engagement and justified follow-up.
Private-session recordings are kept only while they are reasonably needed for work with the client, including agreed follow-up. When they are no longer needed for that client work, they are deleted unless a specific legal obligation or need to establish, exercise or defend a legal claim justifies limited further retention.
Live-room and market-preparation recordings are retained for their disclosed replay purpose and related service administration. Marketing permission records are kept while relevant, together with minimal suppression records where needed. Backup copies may follow a separate deletion cycle.
Security
TradeSmart uses reasonable organisational and technical measures appropriate to the information and services involved, including access restrictions and use of established service providers. No internet transmission or storage system can be guaranteed completely secure. Contact TradeSmart promptly if you believe your account or information has been misused.
Your rights
Depending on applicable law, you may have rights to inspect or access personal information, correct inaccurate information, request deletion, restrict or object to processing, receive a portable copy, or withdraw consent. These rights can have legal limits, including where records must be retained.
Israeli law provides rights concerning access to and correction of personal information in the circumstances it specifies. Other rights may apply if another data-protection regime governs the processing. Contact simon@tradesmart4x.com with enough information to identify your request. TradeSmart may request proportionate identity verification through an appropriate process.
You may also complain to a competent data-protection authority where applicable, including Israel's Privacy Protection Authority.
Adults and policy changes
TradeSmart's services are intended for adults aged 18 and over. If you believe a child has provided information, contact TradeSmart so the situation can be assessed.
This policy may be updated prospectively. Material changes will be dated and additional notice will be given where required. A policy update does not create consent for a new purpose that legally requires permission.
