These terms govern use of the TradeSmart website. Purchases are governed by the Training and Services Terms and Conditions, the relevant offer and order confirmation, and the Cancellation, Withdrawal and Refund Policy. The Trading Education Disclaimer and Risk Disclosure explains the educational scope and trading risks. The Privacy Policy explains how personal information is handled.
The website and TradeSmart services are intended for adults aged 18 or over who have capacity to enter the relevant agreement. Do not register or purchase using false information or another person's identity.
Educational information
Website content describes trading education and trader-development services. It must be read with the Trading Education Disclaimer and Risk Disclosure. It does not guarantee a trading outcome or replace independent professional advice about your circumstances.
TradeSmart aims to keep material information accurate. If a material error affects an order, TradeSmart will address the order fairly and in accordance with the agreement and applicable law. A general error provision will not be used to impose a higher price without agreement.
Permitted use and intellectual property
TradeSmart and its licensors retain rights in training, recordings, text, diagrams, branding, methodology materials and other content. Subject to your purchase terms and applicable law, material supplied to you is for your own learning and personal use unless a different licence is expressly agreed.
Do not share account credentials, redistribute paid materials, sell copies, publish session recordings, reproduce substantial course content, or use TradeSmart materials to deliver a competing course without permission. These restrictions do not remove statutory exceptions or rights that cannot lawfully be restricted.
You must not interfere with the website, bypass access controls, introduce malicious software, scrape personal information, impersonate another person or use the service unlawfully. In interactive sessions, do not harass participants, disclose another person's confidential information, solicit investments or promote unauthorised services.
Material you provide
You retain ownership of your original trading records, questions and other material. Supply only material you are entitled to share. You give TradeSmart the limited permission needed to receive, store and use it to answer your request or provide the agreed service, subject to the Privacy Policy.
Sending a question or joining a session does not give TradeSmart a general right to publish your identity, private correspondence or trading records for promotion. Identifiable marketing use requires separate permission.
External services and availability
The website connects to checkout, payment, course, support, meeting and other services. Their own terms and privacy notices may also apply to your use of those platforms. A link to a third party does not imply that the third party is suitable for your trading needs.
Temporary interruptions can occur. Where a fault affects a paid service, TradeSmart will take reasonable steps to address it and provide any remedy required by the agreement and applicable law. General website maintenance does not cancel purchased rights.
Accounts and misuse
Keep account credentials secure and report suspected unauthorised access. TradeSmart may reasonably restrict access to address serious misuse, security risk or unlawful conduct. Where practicable, TradeSmart will explain the reason and give an opportunity to respond or correct the issue.
A restriction for misuse must be proportionate. It does not automatically forfeit payments, erase contractual rights or remove a refund or other remedy required by law.
Responsibility, complaints and governing law
You remain responsible for your own trading decisions. TradeSmart does not accept responsibility for a trading loss merely because educational material was used. This does not exclude responsibility for breach of TradeSmart's contractual or legal duties, fraud, misleading conduct or liability that cannot lawfully be excluded.
Complaints may be sent to simon@tradesmart4x.com or through the TradeSmart Help Desk at https://go.tradesmart4x.com/MainHelpDesk. These terms do not prevent you from approaching a regulator or competent court where you have the right to do so.
These terms are governed by the laws of Israel, subject to mandatory consumer protections and jurisdiction rights available under applicable law. A customer is not required by this clause to waive mandatory protections that apply in the customer's country of habitual residence.
TradeSmart may update website terms prospectively, with notice where required. Existing purchases remain governed by the terms applicable to them unless a valid change is agreed or otherwise permitted by law. If a provision is unenforceable, the remaining provisions continue so far as lawful.
