Training and Services Terms and Conditions

Your order and agreement

These terms apply to TradeSmart training and educational services purchased under them. The offer and checkout should identify the service, included content, price and currency, applicable taxes or charges, delivery arrangements, access period or hosting basis where applicable, renewal terms and cancellation information before payment.

Your order confirmation records the purchase. A specific written service agreement, order or checkout term takes priority over a more general description where it is more specific, but no document removes mandatory rights or permits a misleading omission.

Only the services expressly included in your purchase are included. A reference to another TradeSmart service does not mean that it is included. No customer is required to buy a complete sequence of TradeSmart products or services.

Recorded courses

How To Read The Market Professionally and How To Run A Trading Business are recorded training programmes. Each currently consists of five recorded sessions with immediate on-demand access after purchase, subject to successful payment and account setup.

Unless the particular order states otherwise, access to these recorded programmes continues for as long as TradeSmart continues to host and make the purchased programme available. This is not a promise of lifetime hosting or perpetual operation of any particular platform. TradeSmart will not use these terms to impose a new undisclosed expiry on an existing purchase.

The purchase is for the named programme and does not include Live Trading Room membership, private coaching, downloadable materials, certificates, community access or other support unless expressly included in the order.

Commercial policy for these recorded programmes: no refunds and all sales are final, except where applicable law gives a cancellation, withdrawal, refund or other remedy that cannot lawfully be excluded. A remedy for non-delivery or materially nonconforming content is not removed by the final-sale policy.

Live Trading Room and recurring services

The Live Trading Room provides live educational market analysis and application of TradeSmart's methodology, together with the elements described in the current offer. Weekly Market Analysis & Preparation is also available as a separate recurring service where offered. These services are educational; they are not trade-copying or account-management services.

The checkout and order confirmation control the introductory charge, recurring amount, billing interval and first renewal date for the subscription purchased. Monthly, quarterly and yearly plans remain their respective billing plans unless a different change is expressly agreed.

You may stop future renewal of an active TradeSmart subscription through the TradeSmart Help Desk at https://go.tradesmart4x.com/MainHelpDesk by opening My Orders and using the cancellation option for the relevant subscription. To avoid the next scheduled renewal, complete cancellation before that renewal is processed.

Stopping future renewal does not, by itself, reverse or refund a charge that has already been completed. Access normally continues through the period already paid for. However, a particular cancellation method or platform configuration may end access earlier; where that occurs, the interface or confirmation should indicate the effect. Any mandatory earlier termination, refund or access right under applicable law prevails.

If TradeSmart proposes a change to a recurring price, customers will receive the notice and opportunity to end the subscription required by the agreement and applicable law before a higher recurring charge is applied.

How To Read The Trend + Live Trading Room bundle

Where a purchase includes How To Read The Trend together with a recurring Live Trading Room component, the two components remain distinct for access and cancellation. Cancelling the recurring Live Trading Room component stops future Room renewals but does not cancel the purchased How To Read The Trend training.

Access to the purchased How To Read The Trend training continues for as long as TradeSmart continues to host and make that training available, unless the particular order states a different access term. This is not a lifetime-hosting guarantee.

Private assessments, coaching and implementation

A Root-Cause Trading Assessment, where purchased, includes the preparation, evidence review, private session and written findings described in the current offer or order. The private session is ordinarily 90 minutes where that is the service purchased. It is an educational review of a trading-process issue and not a recommendation to enter a particular investment.

Put It Into Practice, where purchased, provides the private hours and delivery described in the current offer or order. The current structure provides ten private hours, commonly organised in approximately two-hour sessions. Many clients may complete the work within about six months, but that typical period is not, by itself, an automatic expiry of unused hours unless an expiry is expressly agreed before purchase.

Private sessions may be rescheduled without penalty when TradeSmart receives at least 24 hours' notice before the scheduled start time. With less than 24 hours' notice, or for a no-show, the scheduled session may be treated as used and forfeited. TradeSmart may make an exception for a genuine emergency or another circumstance accepted by Simon Klein, and mandatory legal rights remain unaffected.

Commercial policy for private services: payments are non-refundable once made, except where TradeSmart expressly agrees otherwise or applicable law requires a cancellation, withdrawal, refund or remedy. A private session that has already been delivered is non-refundable, subject to applicable law. Where a service includes written findings or other agreed follow-up, cancellation of a session does not remove TradeSmart's obligation to provide work already owed under the order.

Unused private hours are not automatically forfeited or expired merely because a typical completion period has passed, unless an expiry or different treatment was expressly agreed as part of the purchase. Additional hours are a separate purchase and must be agreed before they are supplied.

Delivery, access and technical requirements

Use a valid email address and a compatible internet-connected device. Any material software, account or technical requirement specific to a service should be identified before purchase. Contact TradeSmart if access instructions do not arrive or a technical problem prevents use.

Access is personal to the named purchaser unless a different licence is agreed. Do not share logins or recordings. Changes to delivery technology should preserve the substance of the purchased service or be addressed through an appropriate agreed or legally required remedy.

Payments and recurring authorisation

The checkout must display the total payable and clearly identify any recurring payment authorisation before purchase. A one-time course price is not a subscription. Additional services require a separate agreement and are not automatically added because you purchased training or completed a Diagnostic.

For a subscription, payment authorisation is limited to the renewal arrangement disclosed and accepted at checkout. If a payment fails, TradeSmart may contact you and, where lawful, suspend the affected service after appropriate notice. Nothing in these terms restricts a legitimate complaint, payment dispute or chargeback right.

Participation, privacy and recordings

Participate respectfully and do not disclose another person's confidential information. Do not record, publish or redistribute a session without permission. The Privacy Policy and any session-specific notice explain authorised TradeSmart recording and handling of participant contributions.

Private sessions may be recorded only in accordance with the applicable notice and permission arrangements. Private recordings are retained only while reasonably needed for the client work and relevant follow-up, then deleted unless a specific legal preservation need applies. Identifiable private-session material is not authorised for public marketing without separate permission.

Do not provide brokerage login details or ask TradeSmart to operate your account. Discussion of trading behaviour is educational and is not medical or psychological treatment.

Cancellation, service problems and liability

The Cancellation, Withdrawal and Refund Policy explains how the different service types are treated and how subscription renewal can be stopped. A commercial no-refund or final-sale policy is not a waiver of mandatory consumer rights.

If a paid service is not delivered as agreed, is materially misdescribed or another contractual problem arises, contact TradeSmart so the issue can be investigated and the remedy required by the agreement and applicable law can be provided.

You remain responsible for your own trading decisions. A poor trading outcome alone does not establish that an educational service was defective; equally, an educational disclaimer does not excuse non-delivery, misleading conduct or breach of TradeSmart's legal duties.

Existing purchases, complaints and governing law

These terms apply prospectively from their effective date. They do not retrospectively impose a new access limit, cancellation charge or other disadvantage on an existing purchase.

These terms are governed by the laws of Israel, subject to mandatory protections and jurisdiction rights available under applicable law. This clause does not require a consumer to waive mandatory rights available in the consumer's country of habitual residence.
